The Catholic Church’s defiance and obstruction on child sex abuse

IN THREE years at the helm of the Catholic Church, Pope Francis has been a source of inspiration for millions of faithful around the world. In one critical respect, however, he has fallen short of his own promise: to come fully to terms with decades of child sex abuse by clergymen and the institutional cover granted to them by bishops and cardinals.
Francis has pledged “the zealous vigilance of the Church to protect children and the promise of accountability for all.” Yet there has been scant accountability, particularly for bishops. Too often, the church’s stance has been defiance and obstruction.
In his trip to the United States in the fall, Francis told victims that “words cannot fully express my sorrow for the abuse you suffered.” Yet his initiative to establish a Vatican tribunal to judge bishops who enabled or ignored pedophile priests has come to naught. Not a single bishop has been called to account by the tribunal, which itself remains more notional than real.
Meanwhile, church officials have fought bills in state legislatures across the United States that would allow thousands of abuse victims to seek justice in court. The legislation would loosen deadlines limiting when survivors can bring lawsuits against abusers or their superiors who turned a blind eye. Many victims, emotionally damaged by the abuse they have suffered, do not speak until years after they were victimized; by then, in many states, it is too late for them to force priests and other abusers to account in court.
Eight states have lifted such deadlines, known as statutes of limitations, for victims who are sexually abused as minors. Seven states have gone further, enacting measures allowing past victims — not just current and future ones — to file lawsuits in a finite period of time, generally a two- or three-year window.
A typical case is Maryland, where bills to extend the statute of limitations until the alleged victim turns 38 have failed even to come to a vote, owing to opposition from House of Delegates Judiciary Committee Chairman Joseph F. Vallario Jr. (D-Prince George’s) and the Catholic Church, among others.
In his trip to the United States, Pope Francis praised bishops for what he called their “generous commitment to bring healing to victims” and he expressed sympathy for “how much the pain of recent years has weighed upon you.” Yet by its actions, the church’s “commitment to bring healing” has seemed far from generous. And it seemed perverse to address the bishops’ “pain” when the real suffering has been borne by children.
EXCLUSIVE: Victim raped by upstate priest wants N.Y. to fix sex abuse statute
Kevin Braney went through hell in the basement of a church rectory.
Braney says he was a devout 15-year-old altar boy when Msgr. Charles Eckermann first raped him in a rectory storage room at St. Ann’s Church in Manlius, a suburb of Syracuse. Braney says Eckermann assaulted him at least a dozen times in 1988 and 1989 on a mattress the priest had stashed in the storage room.
“I was taught to trust and believe priests because they were the closest thing to God on Earth, and he told me if I defied him, I was defying God,” Braney said. “He said he had a divine right to abuse me.
“He told me he would put my genitals in a vise if I resisted,” added Braney, now an executive at a mental health agency in Boulder, Colo., and an advocate for sexual abuse victims. “He said he would kill me if I said anything.”
Eckermann, now 84, was defrocked and sentenced to a life of prayer and penance by the Vatican in October 2014 after an investigator hired by the Diocese of Syracuse deemed Braney’s allegations credible. But Braney, 43, is unable to pursue criminal charges or civil litigation against Eckermann or the church because New York’s statute of limitations bars child sex abuse victims from proceeding with cases after their 23rd birthday.
That’s why Braney supports the Child Victims Act, a bill sponsored by Queens Assemblywoman Margaret Markey that would eliminate the statute of limitations in sex abuse cases and open a one-year window for victims of past sexual abuse to file civil suits.
“The best thing for the Catholic Church would be for the law to change and let justice run its course,” Braney said. “It would bring closure for the victims and their families and it would let the church move forward and heal the damage caused by the sex-abuse scandal.”
The Child Victims Act faces stiff opposition from the Catholic Church, including the Diocese of Syracuse, but diocesan spokeswoman Danielle Cummings called Braney “courageous” for speaking out about the abuse.
Church officials weren’t always so sympathetic, Braney said. When he finally found the guts to tell another priest about Eckermann’s abuse, the priest hit him in the face.
Church officials were reportedly put on notice about sexual misconduct by Eckermann, who served on the Syracuse board of education and was a high school teacher and principal, four years before he began abusing Braney.
Braney says he was also raped by another priest, the Rev. James Quinn, in 1989 during a rehearsal for his confirmation.
“He took me to a room in the rectory and raped me,” Braney said. “I was frozen. I was disconnected from my body. I just wanted it to end. I remember I focused on a clock. It was 4:23 in the afternoon.”
Eckermann could not be reached for comment. Quinn died in 2013.
Braney says he dealt with the internal demons unleashed by the sexual abuse by throwing himself into sports and his studies. He became a star lacrosse player at Brown University and moved to the Denver area, where he earned a doctorate in education at the University of Colorado. He later became the principal of Boulder High School.
Braney was working with teens who had been abused — when the memories he repressed for decades came flooding back about four years ago.
Braney’s pain became public in March 2013, when police were called to his home during an argument with his former wife. He told the Boulder cops who arrested him on suspicion of domestic violence that he was dealing with the stress that came from his abuse. The police told Braney — who later pleaded guilty to a misdemeanor for damaging property — to contact Syracuse-area prosecutors or police.
The Onondaga DA’s office investigated Braney’s claims, but prosecutors told Braney they could not file charges because the statute of limitations had expired.
Current Syracuse bishop Robert Cunningham has apologized to Braney for the abuse and the diocese has paid for therapy. But Braney wants more: He wants transparency. He wants the diocese to publicly identify clergy who also face credible allegations of abuse.
Cummings said the diocese is reluctant to do so because other victims who have come forward have asked to keep details of their abuse — including identities of the abusers — private.
Braney said that practice puts the responsibility for transparency on victims and survivors.
“It perpetuates the shame and secrecy,” Braney said. “Most of all it protects pedophiles.”
NY Bishop Rape Shames Abuse Victims: Boys Are ‘Culpable’ For Their Actions At 7 Years Old

Bishop Robert Cunningham of the diocese of Syracuse, NY doesn’t think priests should take all of the blame for decades, if not centuries, of sexual abuse against young boys. According to Cunningham, the “age of reason” in the Catholic church is seven, so those boys are culpable for their actions.
The shocking statement came during testimony that was recently released from a deposition for a federal lawsuit. Charles Bailey, a survivor of a priest’s abuse, asked then-Bishop James Moynihan whether the church held children victims partly responsible for sexual abuse from priests . “(Bishop) Moynihan said that right to my face – ‘The age of reason is 7, so if you’re at least 7 you’re culpable for your actions.’ That kind of floored me,” said Bailey.
Obviously, the sentiment isn’t something one Bishop believes, but a broader excuse used to cover for the guilt of sexual predators.
The “age of reason” may be seven years old, but that in no way makes it the “age it’s the kid’s fault he was raped.” According to church doctrine, seven is the age a child should understand the difference between right and wrong. It’s also the age a child is eligible for communion.
A spokesman for the diocese has been trying to defend the bishop, saying that his statements in a deposition don’t mean he believes children are responsible for being raped and that it was “unfair to use the deposition to characterize his position otherwise.”
“Unfair may not quite cut it where this man is concerned. When pressed on the issue, he said it wasn’t his place to know how much guilt was on the victim’s hands. The simple answer, “none,” became another distorted version of reality that somehow makes it at least partially a child’s fault when a priest abuses him.
“Well, I mean, without knowing the circumstances completely, did the boy encourage, go along with (it) in any way?” Cunningham asked. The lawyer asked Cunningham if he could imagine any circumstance in which a 14- or 15-year-old boy could be held responsible in the eyes of the church when a priest asks him to engage in sex.
“Obviously, what the priest did was wrong,” Cunningham said. “You’re asking me if the young man had any culpability, and I can’t judge that.”
Actually, you can judge that. Anyone can judge that. What happened is priests used their influence and position as “messengers of God” to force children to comply with their perverted sexual desires. In the very least they were forced to make adult decisions they didn’t have the capacity to make. This bishop and all the priests he defended with this mindless argument betrayed the trust of the parishioners and especially the children of the Diocese of Syracuse.
Charles Bailey has circulated a petition he intends to present to Pope Francis in Philadelphia during his visit to remove Bishop Cunningham as the head of the church there.
